Real Estate Restrictions Do Not Change Under Stay at Home Order of December 4, 2020

Dear Members,

On Friday, December 4, Mayor London Breed announced that Bay Area counties will be preemptively implementing the State’s new Stay at Home Order starting on Sunday, December 6, at 10:00 PM. These new restrictions come from the Regional Stay at Home Order issued by Governor Newsom on Thursday.


Here is the specification for real estate from page 20 of San Francisco's Order:
Service providers that enable real estate transactions (including rentals, leases, and home sales), including, but not limited to, real estate agents, escrow agents, notaries, and title companies, provided that appointments and other residential real estate viewings must only occur virtually or, if a virtual viewing is not feasible, by appointment with no more than two visitors at a time residing within the same Household and one individual showing the unit (except that in person visits are not allowed when the occupant is present in the Residence);

SUMMARY:
The new Stay at Home Order does not change our current real estate COVID-19 restrictions and regulations.

For the time being, real estate remains an essential service, and the rules REALTORS® have been following under the color-coded tier system still apply. REALTORS® will be able to continue conducting business in regions where the new Stay at Home Order has been implemented, provided they follow the state guidelines. REALTORS® must continue to comply with state and local health ordinances in order to reduce the risk of exposure to, and spread of, COVID-19, while providing the essential services of residential and commercial real estate. The Enforcement Division of the Department of Real Estate has made clear that complaints regarding non-compliance with the showing protocols have been and will continue to be investigated.

For your reference, the Order also stipulates that beginning on Sunday at 10:00 PM, the following sectors must close: 
  • Indoor and outdoor playgrounds
  • Indoor recreational facilities
  • Hair salons and barbershops
  • Personal care services
  • Museums, zoos, and aquariums
  • Movie theaters
  • Wineries
  • Bars, breweries, and distilleries
  • Family entertainment centers
  • Cardrooms and satellite wagering
  • Limited services
  • Live audience sports
  • Amusement parks
Additionally, the following sectors will have modifications beyond 100% masking and physical distancing:
  • Outdoor recreational facilities: Allow outdoor operation only without any food, drink or alcohol sales. Additionally, overnight stays at campgrounds will not be permitted.
  • Retail: Allow indoor operation at 20% capacity with entrance metering and no eating or drinking in the stores. Additionally, special hours should be instituted for seniors and others with chronic conditions or compromised immune systems. 
  • Shopping centers: Allow indoor operation at 20% capacity with entrance metering and no eating or drinking in the stores. Additionally, special hours should be instituted for seniors and others with chronic conditions or compromised immune systems.
  • Hotels and lodging: Allow to open for critical infrastructure support only.
  • Restaurants: Allow only for take-out, pick-up, or delivery.
  • Offices: Allow remote only except for critical infrastructure sectors where remote working is not possible. 
  • Places of worship and political expression: Allow outdoor services only.
  • Entertainment production including professional sports: Allow operation without live audiences. Additionally, testing protocol and “bubbles” are highly encouraged.
The following sectors are allowed to remain open when a remote option is not possible with appropriate infectious disease preventative measures including 100% masking and physical distancing:
  • Critical infrastructure 
  • Schools that are already open for in-person learning
  • Non-urgent medical and dental care
  • Child care and pre-K
